Various Verdicts & Settlements Obtained So Far
For thirty years, Steven Smedresman has vigorously and tirelessly attacked the insurance companies of this State to exact a measure of justice for his clients. What follows below are just some of the many verdicts and settlements Steven Smedresman has obtained for his firm's clients. Keep in mind that prior results do not guarantee a similar outcome, as every case is different.
$5,000,000.00
For car accident victims. On September 24, 2019, on I-95, near Newark, Delaware, a tractor trailer owned by a trucking company rear ended my client’s car on the highway, propelling it into a ditch, tragically causing the death of my client’s daughter who was ejected from the vehicle, and breaking my client’s spine. Working with a nationally recognized outside counsel a settlement of $5,000,000.00 was achieved. The truck carried only $1,000,000.00 in insurance, but we were able to compel the company to pay an additional $4,000,000.00 out of its own pocket to settle the case.
$3,000,000.00
For a pedestrian struck by an NYPD vehicle. On December 9, 2008, near Intervale Avenue and the Grand Concourse, Bronx, NY, my client, a 21 year old dancer from the Bronx, was struck by a NYPD patrol car driven by an NYPD officer who was driving carelessly. The resulting impact fractured her skull, tibia, fibula and elbow, and caused internal injuries. The lawsuit I brought against the NYPD and the City of New York was settled on the eve of trial for a lump sum up front payment of $3,000,000.00, providing a lifetime income to my client.
$2,000,000.00
For dog bite victim, January 9, 2014, 3:00 PM, Webster Ave. near East 181st Street, Bronx NY. In this tragic case my client was viciously attacked by a Rottweiler kept at the outdoor parking garage where my client parked his work van. The dog grabbed, bit, and tore my client’s genitals, causing irreparable damage, both physical and psychological. The difficulty in such cases is proving the dog had a prior vicious propensity to bite. I was able to establish proof of a prior bite, thus ensuring a winning case. Before trial the case settled for $2,000,000.00.
$500,000.00
For a car accident victim following a hit in the rear crash in the Bronx. While the insurance company for the careless motorist argued that all my client's injuries pre-dated the accident, I was able to secure expert testimony and evidence that the trauma of the accident impact had in fact caused her injuries entitling her to compensation
$495,000.00
For a Bronx client who tripped and fell over a raised section of sidewalk. Using Google Maps to establish the dangerous sidewalk condition had existed on the defendant's property for many years, I was able to prove that the homeowner's failure to repair that condition, despite its long existence, made the homeowner responsible for the trip and fall accident and my client's injuries.
$3,000,000
The settlement, following a $10,100,000.00 verdict, for a Queens County construction worker's fall from a height while working.
$2,200,000
Settlement for a pedestrian struck by a commercial van that was leased from Ford Motor Credit. She sustained permanent memory and functional losses.
$2,100,000
Verdict for a plumber who brought suit under New York State's Labor Laws for severely fractured bilateral calcanei (bottom of both feet) who fell off a ladder while installing ceiling pipe.
$1,800,000
Settlement against New York City Health & Hospital Corporation for a pedestrian struck by a car on the Lower East Side, who was then a victim of medical malpractice, resulting in paraplegia.
$1,150,000
For a pedestrian whose legs were run over after a commercial truck struck her as she was crossing the street near Union Square East.
$650,000
For crush injuries and fractures sustained by a driver of a commercial sanitation truck, which was clipped by a hit-and-run car and forced into a concrete pillar near the Bruckner Expressway. The case was resolved under the uninsured motorist provision of the truck driver's policy.
$300,000
(Policy limit) for a fracture of a driver's calcaneus (bottom of the foot) following a rear-end auto accident on the Major Deegan Expressway.
$250,000
For a pedestrian struck by a hit-and-run car, only partially identified by police but whose true identity became known through vigorous private investigation on behalf of a client.
